Our Commitment to Your Privacy

Brivana Healthis required by law to maintain the privacy of your child's protected health information ("PHI"), to provide this Notice describing our legal duties and privacy practices, and to follow the terms currently in effect. This Notice applies to the clinical and health information we create or receive in connection with your child's assessment and ABA therapy — for how we handle information submitted through this website generally, see our Privacy Policy.

How We May Use and Disclose Health Information

We use and disclose PHI without your written authorization for:

  • •Treatment— coordinating your child's assessment, treatment plan, and ABA therapy among our BCBAs, RBTs, and any other providers involved in their care.
  • •Payment — verifying insurance benefits, submitting claims, and obtaining prior authorization for services.
  • •Health care operations — quality improvement, staff training and supervision, and other activities needed to run our practice.

We may also disclose PHI, as permitted or required by law, for purposes such as: reporting suspected child abuse or neglect, complying with a court order or subpoena, public health and safety reporting, health oversight activities, and responding to a serious threat to health or safety.

Any other use or disclosure of PHI — including for marketing, or sale of PHI — requires your prior written authorization, which you may revoke at any time.

Your Rights

As a parent or guardian acting on your child's behalf, you have the right to:

  • •Request and receive a copy of your child's records.
  • •Request that we amend records you believe are incorrect or incomplete.
  • •Request an accounting of certain disclosures we've made of your child's PHI.
  • •Request restrictions on certain uses or disclosures, or that we communicate with you in a specific way or at a specific location.
  • •Request a paper copy of this Notice at any time, even if you agreed to receive it electronically.
  • •Be notified in the event of a breach of unsecured PHI.

Our Responsibilities

We are required by law to maintain the privacy and security of your child's PHI, notify you if a breach occurs that may have compromised it, follow the terms of the Notice currently in effect, and not use or share information other than as described here without your written authorization.

Changes to This Notice

We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have as well as any we receive in the future. The current Notice will always be available on this page and at our office.

Complaints

If you believe your child's privacy rights have been violated, you may file a complaint with us using the contact information below, or with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.
